Instead, it appears to have settled in, casting a long shadow over the hopes of countless binational couples.
"Officers will be looking deeper... leaning into their discretion more often than they did in the Biden years. They are already spending more time verifying marriages and we are seeing an increase in requests for evidence," warns Ashwin Sharma, a seasoned immigration attorney, speaking to TOI's Lubna Kably. His words paint a clear picture: immigration officials are no longer taking "I do" at face value. They're playing detective, meticulously scrutinizing every detail of your relationship.
This intensified scrutiny is hitting couples in different ways depending on their situation. For those with US citizen spouses living abroad, the consular interview is becoming a pressure cooker. The US citizen spouse isn't even allowed to be present, placing the entire burden of proving the legitimacy of the marriage squarely on the shoulders of the foreign spouse and the documents they can provide.
Sharma emphasizes the weight these documents now carry. "Documents have to tell the full story: how the relationship began, genuine intent to live a married life together, how it's been sustained, and why it is bona fide. That means clear evidence of communication, visits, shared plans, and/or family involvement." Think beyond a few casual texts – we're talking detailed call logs, plane tickets documenting visits, joint vacation itineraries, and even heartfelt testimonials from family members who can vouch for the authenticity of your bond.
Snehal Batra, a managing attorney at NPZ Law Group, echoes this sentiment, advising applicants to prepare an arsenal of documentation. Money transfer receipts showcasing financial support, detailed call logs proving consistent communication, a plethora of photos capturing your journey as a couple, joint bank accounts demonstrating shared finances, and even life insurance policies naming the spouse as a beneficiary are becoming increasingly crucial pieces of the puzzle. And be prepared to answer deeply personal questions about your spouse – their current job, salary, education history, and even details of any prior marriages. No stone is being left unturned.
But the path is even more treacherous for those married to green card holders. The wait for a green card in this category is already notoriously long, often stretching to three or four years. This prolonged separation is now breeding even greater suspicion from immigration officials. "The longer the wait, the more documentation you'll need — pictures, financial records, continuous communication — to convincingly show that your marriage isn't just alive but thriving despite the distance," Sharma cautions.
He also highlights the significant power wielded by consular officers, particularly in busy posts like Mumbai, to issue 221(g) refusals (essentially putting the application on hold for further review) or even refer petitions for outright fraud investigation. "Under the current administration, we can expect this discretionary power to be used more liberally and aggressively. Absence may make the heart grow fonder, but for immigration officers, prolonged absence makes suspicion grow stronger," Sharma grimly notes.
For couples already within the US, the in-person interview with US Citizenship and Immigration Services (USCIS) has also become a more intense affair. While legitimate cases with solid documentation are reportedly still holding up, the pressure is mounting, even for genuine couples with less robust paperwork.
And then there's the dreaded "Stokes interview." While attorneys haven't reported a massive surge in these separate, intensely personal interrogations, the possibility looms for couples deemed particularly suspicious. Imagine being grilled individually about the most intimate details of your daily life, your answers then meticulously compared for any inconsistencies. The questions can range from the mundane – which side of the bed do you sleep on? Who woke up first today? How many windows are in your bathroom? – to the deeply personal – does your spouse have any food allergies? How many locks are on your front door? It's an interrogation designed to unearth any cracks in a fabricated relationship.
While a well-prepared, legitimate case still has a fighting chance, the message from immigration attorneys is clear: be prepared, be thorough, and if you're facing a Stokes interview, lawyer up. "Well-prepared, legitimate cases appear to be still holding up well under scrutiny. But it's also true that even genuine couples with weak documentation are going to feel the pressure," Sharma warns.
The stakes are incredibly high. As Batra points out, "If a green card is denied due to an alleged marriage fraud, the spouse can be placed in removal proceedings (deportation)." That's the chilling reality facing couples who can't adequately prove the authenticity of their love story under this heightened level of scrutiny.
So, what's the takeaway for couples navigating this increasingly complex landscape? Love might conquer all in the movies, but in the realm of US immigration, it needs a hefty supporting cast of meticulously documented proof, unwavering honesty, and perhaps even a good immigration attorney on your side.
